ah, i remember those… (i don’t really get why they did it, but I imagine if one of those made a lot of money or got bought by their competitors, they’d have cared a bit more.)

Everyone in this thread should read the actual patent text, it is very clear that this wouldn’t be an infraction as long as the planets were either bundled with the game or not downloaded automatically as the player explores.

The patent just defines as user creations so planets could definitely count as long as there is some kind of user input on what the planet looks like (probably would be enough if there’s a couple of planet customization sliders):

In each stage of the evolution process, the player can create game content that is uploaded to a server. Other players’ game content can also be downloaded into the player’s game. In an embodiment of the present invention, the player-defined content can be automatically uploaded to a server, where it can be automatically downloaded to players’ games in accordance with criteria such as heuristics that are relevant to the game, player preferences, rankings, community preferences and combinations thereof.

Only if they implement either manual or automatic uploading of creatures (or other player created evolutionary content) and automatic downloading of those creatures to other players.

It’s an another “Spore spiritual successor”, but this one took it far closer to the aesthetic of Spore.

They’re absolutely getting copystriked by EA if they get successful.

Like, all power to them, they’re doing the same thing as Thrive but in a different vein, but that looks basically just like ‘Spore Remastered’. The artstyle is way too similar.

What have they copied? You cannot be copyright struck unless you copy something directly. Like Palworld is being sued based on a patent that Nintendo filed after Palword was released. That shows how little “ammunition” they had to sue the game. So when everyone on the internet said that Nintendo would copyright strike Palword, they were all clueless. This is a similar situation where even if it visually looks clearly inspired by Spore, there isn’t anything legally wrong unless Elysian Eclipse literally copied some art, model, or text, not just made stuff that looks similar and clearly inspired by something else.

EE will not be sued unless it copies the “creation sharing” patent spore has.

It’s EA… You’re underestimating how evil big companies are. palworld was not sued because it looked liked pokemon, it was sued because it was a successful game that partnered with sony. There are dozens of pokemon fangames that legitimately steal copyrighted material that no one cares about because they aren’t successful. EE is at risk not if it uses specific materials or mechanics, but if it makes too much money. It likely won’t though.

And this is also exactly why they took so long to find something they could attack with, because they cannot use the usual big company strategy of just draining someone of money until they give up.

This is also not usually what triggers the big companies. They also need to gain something from all of the money they burn on their own lawyers. Nintendo only attacked the Switch emulators recently as they are gearing up for a Switch 2 announcement (and release) somewhat soon. And Rockstar hit fan ports with DMCAs when they were about to release their own botched remaster collection.

It is very unlikely that EA is looking to re-enter the genre and any game that earns so crazy money that they would be noticed, would also have enough to fend off any frivolous lawsuits. So there’s no chance in my opinion that they would sue EE.

They still upkeep spore I guess. Apparently not long ago they have hired a new team for maintaining spore.
